ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY 1. ASSUMPTION OF RISK. I understand that participation in Row for Westborough — including indoor rowing, relay racing, fitness activities, and related event activities — is physically demanding and carries inherent risks that cannot be eliminated, including but not limited to: muscle strains and sprains, musculoskeletal injury, heat-related illness, cardiac events, aggravation of pre-existing conditions, contact with equipment or other participants, and, in rare cases, permanent disability or death. I VOLUNTARILY AND KNOWINGLY ASSUME ALL SUCH RISKS, both known and unknown, arising from my participation. 2. FITNESS TO PARTICIPATE. I certify that I am in adequate physical condition to participate, that I have no medical condition that would make participation unsafe, and that I have had the opportunity to consult a physician beforehand. I agree to stop participating and notify event staff if I feel unwell. 3. RELEASE AND WAIVER. In consideration of being permitted to participate, I, for myself and my heirs, assigns, and personal representatives, RELEASE, WAIVE, AND FOREVER DISCHARGE Prototype Training Systems, the Westborough Athletic & Social Association (WASA), the Westborough Athletic Booster Association, Inc., and their respective owners, officers, directors, employees, coaches, volunteers, sponsors, and agents (the "Released Parties") from any and all claims, demands, or causes of action arising out of or related to my participation in the event, INCLUDING THOSE ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES, to the fullest extent permitted by Massachusetts law. 4. INDEMNIFICATION. I agree to indemnify and hold harmless the Released Parties from any claims brought by me or on my behalf arising from my participation. 5. MEDICAL AUTHORIZATION. I authorize event staff to secure emergency medical treatment on my behalf if needed, at my expense. 6. PHOTO/VIDEO RELEASE. I grant the event organizers the right to use photos and video taken at the event, which may include my likeness, for promotional purposes without compensation. 7. MINORS. If the participant is under 18, I certify that I am the participant's parent or legal guardian, that I make these agreements on the minor's behalf, and that I accept these terms in full. I HAVE READ THIS AGREEMENT, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS BY AGREEING TO IT, AND AGREE TO IT FREELY AND VOLUNTARILY.
